Donald Trump is heading into the most perilous phase of his hush money trial aside from the moment when the jury retires to consider its verdict. Merchan also instructed Trump’s attorney, Todd Blanche, to rein in his client after complaining that the defendant had cursed audibly and shaken his head during Daniels’ testimony. The judge was concerned that the jury might notice the witness being intimidated — which he warned he could not allow to continue. So far, Trump — who has launched searing attacks on the judge — has managed to refrain from openly attacking Daniels since she took the stand. And her appearance is only an appetizer for expected explosive evidence in the coming days of the biggest star witness, Trump’s former lawyer and fixer Michael Cohen.

Could Trump's next courtroom outburst or gag-violating Truth Social post really be the final straw that gets him locked up on contempt of court? "You get more due process" when you commit an act of contempt outside the courtroom, Levine said. "It's when the judge calls the court officers and tells them to surround the defendant so that he doesn't try to walk out of the courtroom." AdvertisementBut Trump already has at least two court officers standing behind him at all times in Merchan's courtroom, for his own protection. Reality will instead set in when the judge gives what's usually the final instruction to the court officers, "Take charge," Galluzzo said.

Her evidence on Tuesday was deeply embarrassing for Trump and drew an aggressive cross-examination from his attorney trying to shatter Daniels’ credibility. And her appearance is only an appetizer for expected explosive evidence in the coming days of the biggest star witness, Trump’s former lawyer and fixer Michael Cohen. The coming days will therefore require qualities that Trump has always struggled to demonstrate in a riotous life in business and politics: restraint and self-discipline.

“If that story was untrue, I would have written it to be a lot better,” Daniels said of her encounter with Trump. “You have a lot of experience of making phony stories about sex appear to be real,” Necheles asked. “You’re celebrating the indictment by selling things from your store,” Necheles asked. “Not unlike Mr. Trump,” Daniels responded. Prosecutor Josh Steinglass said Trump was aware of the “messy details” of the encounter in 2016 and that shows motive for the hush money payment and cover up.

Eventually, Ms. Necheles went straight to the point. Ms. Daniels responded forcefully: “No.”At the conclusion of the day, Mr. Trump’s lawyer, Todd Blanche, asked Justice Juan M. Merchan whether he would modify a gag order to let Mr. Trump respond publicly to Ms. Daniels’s testimony. The judge denied the request and Mr. Trump’s second motion this week for a mistrial. The former president is accused of falsifying business records to hide a $130,000 payment to Ms. Daniels just before the 2016 election, a payment meant to silence her story. Mr. Trump, 77, has denied the charges and says he did not have sex with Ms. Daniels.

CNN —Judge Juan Merchan called out former President Donald Trump’s defense team during their motion for a mistrial Thursday afternoon, telling them there were many times they could have objected to Stormy Daniels’ testimony, but did not. For the second time this week, Merchan expressed surprise that Trump’s lawyers had not objected more when Daniels was on the stand. And for the second time this week, Merchan rejected their motion for a mistrial. Merchan specifically pointed to Daniels’ testimony about the trailer park, in which Daniels suggested Trump told her she would be stuck living in a trailer park before they had sex in 2006. Merchan also referred back to the defense’s opening statement when Blanche denied there was ever a sexual encounter between Daniels and Trump.

Court sketches of Stormy Daniels as she offers unflattering testimony about sex with Trump Artist: Jane RosenbergThis is developing news. Porn star Stormy Daniels will face cross-examination Thursday by lawyers for Donald Trump, after her first turn on the witness stand drew an angry reaction from the former president. Trump's attorneys, who began questioning Daniels on Tuesday afternoon, will likely continue their efforts to undermine her credibility and raise doubts about her account of having sex with Trump. The alleged one-night stand is a key component of the criminal hush money trial in Manhattan Supreme Court. Stormy Daniels arrives at Manhattan Criminal Court on May 09, 2024 in New York City.

Trump's lawyers argued that portions of Stormy Daniels' testimony warranted a mistrial. Daniels had testified Tuesday that Trump didn't use a condom during their sexual encounter in 2006. AdvertisementBlanche was complaining about multiple times in Daniels' testimony when she made graphic, highly salacious accusations against Trump that the lawyer said irreparably prejudiced the jury. Merchan said he wished the discussion of the condom didn't come into the trial and wasn't heard by the jury. Advertisement"For the life of me, I don't know why Ms. Necheles didn't object," he said, while the defense attorney looked toward the floor.

Trump’s lawyers are urging the full panel of appellate judges to rule on the constitutionality of the gag order, people familiar with the matter say. Previously, Trump’s lawyers asked an appeals court judge to take emergency action and stop the trial so they could appeal the gag order. After hearing oral argument, the appeals court judge denied the request and both sides were ordered to file written briefs. Trump’s attorneys are now asking the appellate panel to expedite their ruling on whether the gag order is constitutional. Judge Juan Merchan has found Trump has violated the gag order 10 times and fined him $10,000 for public statements Trump made about certain witnesses and the jury.

The resulting hung jury would be just the vindication that Mr. Trump needs. Even if hiding the purpose of the $130,000 payoff to Ms. Daniels violated New York law, the juror might think, so what? Everyone already knows Mr. Trump is a liar and a cad, a womanizer and a cheat. Again and again, Ms. Daniels testified in much greater detail, and with more editorializing, than was asked of her. Mr. Trump’s lawyers objected often, and when they didn’t, Justice Juan Merchan stepped in himself, testily warning Ms. Daniels more than once to “just answer the questions.”

In her book, Daniels said Cohen threatened to sue shortly after an interview she did with the parent company of Life & Style and In Touch magazine in 2011. He learned late Tuesday afternoon that Judge Aileen Cannon, whom he appointed, indefinitely postponed a trial in his classified documents case in Florida. She told the jury Tuesday about a $130,000 hush money payment she received from Cohen before the 2016 election. But prosecutors allege Trump falsified business records to hide it and to mislead voters in an early bout of election interference. The judge complained that the ex-president was “cursing audibly” during Daniels’ testimony and was shaking his head. “Am I correct that you hate President Trump?” Necheles asked.

Donald Trump posted — and then quickly deleted — a statement Tuesday raging over the witness schedule and the judge in his criminal hush money trial. Trump fumed that prosecutors are not telling defense attorneys which witnesses they plan to call until the day before the witness testifies. "I have just recently been told who the witness is today. This is unprecedented, no time for lawyers to prepare," Trump wrote in the post. Prosecutor Joshua Steinglass told Merchan on Monday the Manhattan District Attorney's office is keeping its witness schedule hidden, in order to stop Trump from targeting people right before they take the stand.

Merchan told Blanche they were speaking at the bench because the judge did not want to embarrass Trump. “One time I noticed when Ms. Daniels was testifying about rolling up the magazine, and presumably smacking your client, and after that point [Trump] shook his head and he looked down. Blanche said he would talk to Trump during the break. Daniels then told jurors that she “spanked” a “rude, arrogant and pompous” Trump “right on the butt” with a copy of one of his magazines. After which, she said, the former president “was much more polite.”CNN’s Jeremy Herb, Lauren del Valle and Kara Scannell contributed to this report.

We can break down Daniels’ testimony by five critical “C” components:Curiosity: From the moment Daniels entered the room on stage right, the jury’s eyes — indeed, all eyes in the courtroom — were on her. Character: Assistant District Attorney Susan Hoffinger spent the first 15 minutes or so of direct examination introducing Daniels to the jury. Join us on Twitter and FacebookCross: As with every witness in this trial, the defense, in this case the able Susan Necheles, landed some blows. More fundamentally, Necheles challenged the witness’ credibility on the 2006 encounter with Trump, pointing out that Daniels had previously denied it as recently as 2018. The widely anticipated testimony of Stormy Daniels did not disappoint.

“The people call Stormy Daniels.”So began the intense and often uncomfortable testimony of Ms. Daniels, who spent almost five hours in a Manhattan courtroom on Tuesday recounting her story of a 2006 encounter with Donald J. Trump and the ensuing hush-money cover-up that has become the bedrock of the prosecution’s case. Ms. Daniels spoke quickly and at length about her first meeting with Mr. Trump at a celebrity golf tournament in Lake Tahoe, Nev.After the lunch break, Mr. Trump’s lawyer Todd Blanche moved for a mistrial, arguing that the prosecution’s questions were designed to embarrass Mr. Trump and prejudice the jury. The judge, Juan M. Merchan, agreed that some of Ms. Daniels’s testimony “may have been better left unsaid,” but denied a mistrial.

Donald Trump's Mar-a-Lago documents trial has been delayed indefinitely. AdvertisementThe judge overseeing Donald Trump's criminal case over his holding onto secret government documents following his presidency delayed the trial indefinitely — giving him the chance to get rid of the charges if he wins the 2024 election. Another criminal case overseen by Smith, in a federal court in Washington, DC, was previously scheduled for March 4. In that case, Smith alleged Trump broke criminal laws through his efforts to overturn the results of the 2020 election. Merchan added he was "surprised" the former president's defense team did not raise more objections during Daniels' testimony.
